Abstract

في دراستنا لموضوع أساليب متابعة المجرمين الدوليين حاولنا أن نلقي الضوء على أهم التطورات التي توصل إليها القانون الدولي الجنائي و التي بدورها جسدت عدة مبادئ وقواعد قانونية دولية تساهم في تحقيق العدالة الجنائية وهذه المبادئ تم تجسيدها في النظام الأساسي للمحكمة الجنائية الدولية، ومن بين أهم هذه المبادئ مبدأ المسؤولية الفردية وهذا باعتبار أن الفرد هو الشخص الدولي الوحيد الذي يمكنه تحمل المسؤولية الجنائية الدولية بمعنى إمكانية مساءلته عن الجرائم الدولية التي يرتكبها بصفته الرسمية كعضو في الدولة أي بإيعاز منها دون مساءلة الدولة باعتبارها شخص دولي اعتباري لا يمكنه تحمل المسؤولية الجنائية الدولية وتوقيع الجزاء الجنائي عليه وهذا لتسهيل عملية المتابعة الجنائية للمجرمين الدوليين. Dans cette étude portée sur les façons de poursuivre les criminels internationaux, nous essayons, dans ce sens, de mettre en lumière les changements survenus dans la loi internationale. En effet, La charte de la Cour Pénale Internationale est la meilleure illustration de ce changement car il contient des principes et règles internationales qui peuvent contribuer à la réalisation de la justice pénale. Entre autres nous pouvons retenir le principes de la responsabilité individuelle qui consiste à prendre l’individu comme la seul personne internationale qui puisse être responsable du crime international, ca veut dire que la possibilité de l’interpeller des crimes qu’il a commis en qualité de son responsabilité comme membre d’Etat sans pour autant interpeller l’Etat car ce dernier est une personne morale qui ne puisse en aucun cas être responsable. En faisant de cette manière nous pouvons poursuivre les criminels internationaux.
