مسؤولية الإدارة عن أعمالها غير التعاقدية

Abstract

قسمنا المذكرة إلى فصلين، الأول بعنوان مسؤولية الإدارة عن أعمالها غير التعاقدية على أساس الخطأ والذي بدوره قسمناه إلى مبحثين الأول تناولنا فيه تعريف الخطأ بنوعيه المرفقي والشخصي وكذلك معايير التمييز بينهما التي أوردها الفقهاء، وبينا أن أساس هذه المسؤولية هو الخطأ المرفقي ثم تناولنا صور هذا الخطأ. أما في المبحث الثاني فتناولنا فيه تقدير الخطأ المرفقي وذلك في القرارات الإدارية وفي الأفعال المادية. أما في الفصل الثاني فكان بعنوان مسؤولية الإدارة عن أعمالها غير التعاقدية على أساس المخاطر وتطرفنا في المبحث الأول منه لنشأة وتطور نظرية المخاطر وكذلك الأسس والشروط التي تتوفر عليها هذه النظرية وفي المبحث الثاني تطرقنا إلى خصائص ومجالات هذه النظرية.

Et nous savons traite dans le second chapitre, la responsabilité de l’administration sans faute ou fondée sur le risque et Tartinai lui dans la première section l’origine et l'évolution de la théorie du risque ainsi que les principes et les conditions qui sont disponibles sur cette théorie, et dans la deuxième section nous avons traité les champs d’application de cette théorie dans les domaines des actes administrative non contractuelle.
