الضوابط المكانية للإختصاص القضائي الدولي للمحاكم الوطنية

Abstract

الضوابط المكانية تعتبر من أهم ضوابط الإختصاص القضائي الدولي و التي تجعل المحكمة الوطنية مختصة بالنظر في النزاع كلما وجد إرتباط بينه وبين الإقليم الوطني للدولة. لم ينظم المشرع الجزائري الضوابط المكانية على مستوى العلاقات الدولية الخاصة الأمر الذي يستدعي في حال غياب إتفاقيات التعاون القضائي، مد العمل بالنصوص الداخلية المنظمة للضوابط المكانية إلى مجال العلاقات الدولية الخاصة. Contrôles spatiale est une des commandes les plus importantes de la juridiction internationale et que rend un tribunal national compétent pour examiner le conflit chaque fois qu'il ya une corrélation entre elle et le territoire national de l'Etat. Législateur algérien n'a pas organisé contrôles spatiales sur le plan des relations internationales qui appelle en l'absence d'accords de coopération judiciaire, l'extension de l'organisation interne des textes contrôle champ spatial aux relations internationales. Mots clés: commandes spatiales, les conventions internationales, la maison, Spatial controls is one of the most important controls of international jurisdiction and that makes a competent national court to consider the conflict whenever there is a correlation between it and the national territory of the state. Algerian legislature did not organize spatial controls on the level of international relations which calls in the absence of judicial cooperation agreements, the extension of the internal organization of the texts controls spatial field to international relations.
