الحماية القانونية للعلامة التجارية في التشريع الجزائري

Abstract

تتمتع العلامة التجارية المسجلة اوغير المسجلة بالحماية القانونية كأصل عام, فإذا كانت مسجلة فإنها تتمتع بالحماية الجزائية والمدنية معا, اما اذا كانت غير مسجلة فإنها تتمتع بالحماية المدنية فقط, وهذا صادقت عليه الجزائر في الاتفاقيات الدولية الخاصة بحماية العلامة التجارية .

Les marques commerciel diposé ent génralement une protection jurdique . Pour la premiére une protection pénale et civile. tandis que la deuxieme n a qué une protection civile. pour ce la l algerie a aprobé au lccords international de la protection de la marque commerciel . The basic general issue with respect of the trademark is the legal protections status, whether being registered or unregistered .If the trademark is registered , then shall enjoy both civil and penal protection, but if the trademark is unregistered, consequently, shall only enjoy civil protection ,and This was ratified by Algeria in international agreements to protect brand.
