الاعتراف و تنفيذ أحكام التحكيم الدولي في الجزائر

Abstract

الاعتراف بحكم التحكيم الدولي ،معناه صدور هذا الحكم بطريقة صحيحة ،اما تنفيذه فهو الإجراء الذي يقدمه المدعي من أجل استيفاء حقه من المدين ،و ترافق عملية الاعتراف مجموعة من الاجراءات هي تقديم اصل الحكم التحكيمي ،وأصل إتفاق التحكيم إلى الجهة القضائية المختصة. أما إجراءات التنفيذ فتقدم نفس الوثائق إلى الجهة القضائية المختصة ، وعندها يأمر قاضي التنفيذ بمنح الحكم التحكيمي الامر بالتنفيذ Reconnaissance en vertu de l'arbitrage international, ce qui signifie l'émission de ce jugement est correct, la procédure est effectuée soit par le Procureur afin de répondre à la droite du débiteur, et accompagner le processus de la reconnaissance d'un paquet de mesures est de fournir la poursuite de la sentence, et l'origine de la convention d'arbitrage à l'autorité judiciaire compétente.
