Abstract

إنالتطورالحاصلفيالعالمالإقتصاديبالأخصفيالدولالمتقدمة ,أثربشكلمباشرفيالدولالناميةالتيبدورهاتريدأنتكونفيمصافتلكالدولالمتقدمة , ومنتلكالدولالناميةنذكرالدولةالجزائريةالتيأخذتتسلكوتتبنىتدابيرقانونيةمنأجلتشجيعالإستثمارالاجنبيوترقيةالإنتاجالوطني،إنهذاالبحثيعدملخصللحوافزالقانونيةللمستثمرالأجنبيفيالتشريعالجزائريوهويعالجطبيعةتلكالحوافزالقانونيةبمعنىحمايةالمستثمرالأجنبيمنالمخاطرالسياسيةوغيرتجاريةالتيقدتلحقبهجراءالإستثمارالذييقومبهخارجإقليمدولتهأيفيالدولةالمضيفة . والذييعنينامندراسةهذهالحوافزالقانونيةهوتحديدطبيعتهاالقانونيةوهلترقىأنتكونحافزاحقيقيلجلبالمستثمرالأجنبيللجزائروالمتمثلةفيمنـــحبعضالمـــزاياوالضماناتالتيتجعلهيستثمرفيمناخمناسب،فمنخلالهذهالدراسةسنحاولأننــــــبينمضمـــونهذهالحـــوافزالقـــانونيةفيالتـــــشريعالداخليوماقامبهالمشرعالجـــزائـريمـــــــــنإبراماتفاقيات (ثنائية ,جماعية,إقليميةودولية ). L'évolution dans le monde économique, en particulier dans les pays développés, a un impact direct dans les pays en développement, qui à son tour, veulent être dans les rangs de ceux des pays développés, et que les pays en développement rappeler à l'Etat algérien qui se comporter et adopter des mesures juridiques afin d'encourager les investissements étrangers et de promouvoir la production nationale, Cette recherche est un résumé des incitations juridiques aux investisseurs étrangers dans la législation algérienne qui traite de la nature des incitations juridiques détecter protéger les investisseurs étrangers contre le risque politique, non-commerciale, qui peut causer un résultat de son investissement se fait en dehors du territoire de tout Etat dans le pays hôte. Et qui nous concerne de l'étude de ces incitations juridiques est de déterminer la nature juridique ne vit pour être une réelle incitation à faire appel à un investisseur étranger en Algérie et de l'octroi de certains avantages et garanties qui rendent l'investissement dans un climat propice, ce est à travers cette étude va essayer de montrer le contenu de ces incitations juridiques dans la législation nationale et ce qu'il par le législateur algérien de la conclusion des accords (bilatéraux, collectives, régionales et internationales). And for us to study these legal incentives is to determine the legal nature lives to be a real incentive to bring in a foreign investor in Algeria and the granting of certain benefits and safeguards that make the investment in a climate, it is through this study will try to show the contents of these legal incentives in national legislation and what by the Algerian Parliament of the conclusion of agreements (bilateral, collective, regional and international).
