التعبير عن الإرادة في العقود الإلكترونية

Abstract

من خلال الجوانب التي تحتويها التجارة الإلكترونية، حاولنا في هذا البحث تسليط الضوء حول مفهوم التعبير عن الإرادة في العقد الإلكتروني، والإشكالات المترتبة عنه من وجهة نظر قانونية وتنظيمية، وهذا نظرا لذيوع هذا المصطلح (العقد الإلكتروني) كوسيلة لإبرام التصرفات، وأثاره القانونية بسبب ارتباطه بتكنولوجيا المعلوماتية. وعليه سيكون بحثنا حول ملامسة بعضا من جوانب التعاقد الإلكتروني من حيث المسائل التالية:  الصور الحديثة للتعبير عن الإرادة في العقد الإلكتروني؛  الإيجاب والقبول في العقد الإلكتروني؛  مشروعية الوسائل الإلكترونية للتعبير عن الإرادة؛  وجود الإرادة وصحة التعبير عنها في العقد الإلكتروني.

Résumé: A travers les aspects du commerce électronique, nous avons essayé dans cette recherche d’éclaircir le concept de l'expression de la volonté du contrat électronique et les entraves qui en résultent du point de vue juridique et réglementaire ; et cela à cause de la prévalence de ce terme (contrat électronique) comme moyen de conclure des actes et ses effets juridiques en raison de sa relation avec la technologie de l'information. En conséquence, notre recherche sera un essai qui touche quelques volets des contrats électroniques en ce qui concerne les questionnements suivants:

 Les nouveaux instruments de l'expression de la volonté du contrat;  L’offre et l'acceptation du contrat;  La légitimité des moyens électroniques pour l'expression de la volonté;  L'existence et la validité de la volonté exprimée dans le contrat électronique.

Abstract: Through the aspects of electronic commerce we have tried in this research to clarify the concept of the expression of the will in the electronic contract and the problems resulting from the legal and regulatory. This perspective is because of the prevalence of this term (electronic contract) as a means to conclude legal acts and their legal effects due to its relation with the information technology.  New forms of expression of the will in the electronic contract;  The offer and the acceptance of the contract;  The legitimacy of electronic means in the expression of the will;  The existence and the validity of the will expressed in the electronic contract.
