فعالية التحكيم في تحقيق ذاتية المنازعات البحرية

Abstract

يعد التحكيم القضاء الأكثر ملاءمة للفصل في المنازعات البحرية لأنه يحفظ طابعها الخصوصي و يدفع عجلة الإستثمار في مجال التجارة البحرية الدولي. ولا يمكن للتحكيم أداء دوره في الفصل في المنازعات البحرية إلا في ظل قيام تعاون بينه وبين القضاء مع ضرورة مراعاة النظام العام الذي قد يشكل عائقا أمام تنفيذ الأحكام التحكيمية التي يصدرها. L’arbitrage est considéré comme la juridiction la plus adéquate pour trancher dans les litiges maritimes, car il préserve leur nature spécifique et encourage l’investissement dans le domaine du commerce maritime international. L’arbitrage ne peut accomplir son rôle pour trancher dans les litiges maritimes, que dans un cadre de coopération avec la juridiction avec la nécessité du respect de l’ordre public qui pourra constituer un obstacle pour l’exécution des sentences arbitrales qu’il prononce. Arbitration is considered as the most appropriate jurisdiction for compromise maritime disputes, because it preserves their specific nature and encourages investment in the field of international maritime trade. Arbitration cannot perform its role to solve maritime conflicts except in a scope of cooperation with the jurisdiction, on condition of the respect of public order which can be an obstacle to the execution of delivered arbitral sentences.
