إزدواجية العمل التشريعي في النظام الدستوري الجزائري

Abstract

إن السلطة التشريعية في النظام السياسي الجزائري بدساتيره الأربعة شهدت تفوقا واضحا للسلطة التنفيذية على حساب السلطة التشريعية، الأمر الذي أدى إلى انقسام مهمة التشريع بين كل من البرلمان و رئيس الجمهورية، وذلك من خلال الصلاحيات الممنوحة له من طرف المشرع الدستوري، والتي جعلت منه في أغلب مراحل النظام السياسي الجزائري المسيطر على المجال التشريعي.Le pouvoir législatif dans le système politique algérien avec ces quatre constitutions ont vu supériorité apparente manifesté par l’autorité exécutif sur celle législatif, qui a conduit à diviser la tâche de la législation entre le parlement et le président de la République, par les pouvoirs qui lui sont conférés par la partie de législateur constitutionnel, qui a fait de lui le dominant de la législation dans la plupart des étapes du système politique algérien.The legislative power in the Algerian political system with its four constututions have seen clear superiority of the executive power in front of the legislatif power , which has led to split the task of legislation between the parlement and the President of the Republic , through the powers granted to him by the constitutional legislator, which made him in most steps of the Algerian political system in control of the legislation.
