المسؤولية المدنية المترتبة عن مضار الجوار غير المألوفة

Abstract

بالرجوع إلى القانون المدني الجزائري فإننا نجده قد تناول مضار الجوار غير المألوفة، وذلك ضمن الباب الأول المنظم لحق الملكية بوجه عام، في القسم الثالث المتعلق بالقيود التي تلحق بحق الملكية، وهذا بموجب المواد من 691إلى 712 من القانون المدني . وحتى نحكم بأن المشرع الجزائري قد عمل على وضع أطر قانونية كافية لتحقيق المسؤولية عن مضار الجوار غير المألوفة، بما يكفل حقوق الجار المضرور خاصة ما تعلق بتقدير الضرر الذي يلحق الجار حيث يترك ذلك للقاضي ما إذا كان التعويض عينيا أو نقديا By reference to the Algerian civil law, we may find it harms of eating unfamiliar neigh-borhood, all within the first door regulator right property in general, in Section III on the restrictions attached to the right of ownership, and that under Articles 691 to 712 of the Civil Code. So we judge that the Algerian legislature has worked on the development of adequate legal frameworks to achieve responsibility for the harms neighboring unfamiliar, in order to ensure the rights of the injured neighbor, especially those attached to estimate damage to the neighbor where the leaves so as to judge whether the compensation in kind or cash. En référence à la loi civile algérienne, on peut le trouver nuit de manger quartier inconnu, le tout dans le premier régulateur de porte droit de propriété en général, dans la section III sur les restrictions liées au droit de propriété, et qu'en vertu des articles 691-712 du Code civil. Donc, nous jugeons que le législateur algérien a travaillé sur le développement de cadres juridiques adéquats pour atteindre la responsabilité des torts voisins inconnus, afin de ga-rantir les droits du voisin blessé, en particulier ceux qui sont attachés à estimer les dom-mages au voisin où les feuilles afin de juger si la compensation en nature ou en espèces.
