حمـــاية المجــلس الدستـــوري لمبـــدأ المســـاواة

Abstract

نظرا للمكانة التي يتمتع بها مبدأ المساواة فإنه في حاجة دائمة وضرورية للحماية، لهذا لجأت الدساتير الحديثة إلى التأسيس له ضمن دساتيرها لضمان احترامه من قبل جميع المؤسسات والإدارات العمومية، بل حتى من طرف منتجي النصوص القانونية. وفي هذا الإطار أنشأ المجلس الدستوري الجزائري كجهاز مكلف بالرقابة على دستورية القوانين، مراعيا في آرائه وقراراته احترام النصوص القانونية لمبدأ المساواة، بل الأبعد من هذا استند المجلس الدستوري لهذا المبدأ في حمايته للعديد من الحقوق الأساسية ضد مساس المشرع بها. Étant donné l'importance du principe de l'égalité, il a un besoin permanent et nécessaire de protection, de sorte que les constitutions modernes ont recouru à l'incorporation dans ses Constitutions pour s'assurer qu'elle est respectée par toutes les institutions publiques et les administrations, et meme par les producteurs de textes légaux. Dans ce contexte, le Conseil constitutionnel algérien a été créé en tant qu'organe chargé de surveiller la constitutionnalité des lois, en tenant compte Ses vues et ses décisions respectent les dispositions légales du principe d'égalité, et plus encore, le Conseil constitutionnel a invoqué ce principe dans sa protection de nombreux droits fondamentaux contre son manquement Given the prominence of the principle of equality, it has a permanent and necessary need for protection, so modern constitutions have resorted to incorporation within its constitutions to ensure that it is respected by all public institutions and administrations, and even by producers of legal texts. In this context, the Algerian Constitutional Council has been established as a body responsible for monitoring the constitutionality of laws, taking into account its views and decisions to respect the legal provisions of the principle of equality, and even more so, the Constitutional Council has invoked this principle in its protection of many fundamental rights against its infringement by the legislator.
