Abstract

The municipality is the core of the decentralization and an instrument that combine people to organize their local issues The municipality consists of deliberation staff, The Municipal Popular Council, “APC” which is a executive branch presided by The municipal popular council head and an administration headed by the general secretary of the municipality under the responsibility of the municipal popular council head.Due to the direct contact of the community with the municipality, the Algerian legislator gives it broad jurisdictions The municipal popular council is given a lot of jurisdictions either as a representative of the municipality or as a representative of the state as.These jurisdictions are restricted by submitting them to the tutorship authority by virtue of the law in supervising the APC and can dissolute it , upon its members as well as upon the agenda of the APC through certificating or substituting the municipal popular council. L’assemblé populaire communal est une source importante de la décentralisation, elle représente une espace idéale pour la participation des citoyens des citoyens dans la gestion des affaires locales. Vu le rôle primordiale que joue la commun, le législateur algérien a organisé cette assemblé dans des décrets relatives depuis la loi de la commune de 67/24 jusqu’au la présente 11/10. La commune se compose de d’un corps de délibération qui est L’assemblé populaire communale, elle est un corps exécutif présidé par le maire ; et une administration activée par le secrétaire générale sous le pouvoir du maire. Vu sa relation directe avec les citoyens, le législateur a aussi offert au maire des autorités qui ne sont pas vraiment fixés mais justement mentionnés. Il est aussi offert d’autres pouvoirs en tant comme un représentant de la commune et de l’état. Ces pouvoirs sont contrôlés par le pouvoir tutelle représenté par Le Wali par la force de la loi, ces pouvoirs peuvent être : de contrôler L’APC et le résoudre s’il ya lieu et aussi les contrôler aussi membres qui peuvent être arrêtés, exclus et même sur l’or
