الحماية الجز ا ئية للمستهلك من الإعلان التجاري الكاذب والمضلل

Abstract

يعد االعالن التجاري احلايل من ابرز مسات العصر، فهويعترب عامال رئيسيا يف عملية التسويق ، و ضرورة من ضرورات احلياة العصرية ، نظرا ملا حيوي من فوائد مجة للمستهلك و العون االقتصادي ،فهو مظهر من مظاهر املنافسة املشروعة و وسيلة من وسائل التعريف باملنتجات واخلدمات ، ولكن يف الوقت نفسه ميكن ان يتحول اىل وسيلة اضرار باملستهلك بسب املعلومات املغلوطة و اخلادعة ، مما استدعى تدخل املشرع اىل ضبط هذا النشاط من خالل القانون 40/40 املؤرخ يف 0440/40/09 احملدد للقواعد املطبقة على املمارسات التجارية ، و خلقه آلليات مساعدة توفر احلماية الفعالة للمستهلك من هذه الظاهرة املتمثلة يف اهليئات الرمسية و الغري رمسية ، ولكن هذا كله غري كاف حلماية املستهلك من خطر هذه االعالنات ، لذا على املشرع ان يعيد النظر يف العقوبة املفروضة على هذه اجلرمية ، وذلك بإضافة عقوبة سالبة للحرية لعقوبة الغرامة ،من اجل إضفاء النزاهة واملشروعية يف املعامالت بني املستهلك والعون االقتصادي و أيضا جيب على املشرع يف هذا الصدد ان يقوم بإصدار قانون خاص ينظم اإلشهارات ويقوم بوضع ضوابط هلا ويف املقابل ال يبالغ يف وضع هذه الضوابط لكي ال يقوم بعرقلة هذا النشاط . The announcement traders at the present time of the most striking features , it is considered a major factor in the marketing process , and a need of necessities of modern life , because it significant benefits for the consumer and the economic assistance , is a face of legitimate competition and a mean of identification of goods to the way harm the consumer of misinformation and deceptive , prompting intervention of the legislator to adjust this activity through law 02/04 ,dated 06/23/2004 , it set the rules applicable to business practices , and create mechanisms to help provide effective protection to the consumer from this phenomenon of official organizations and not official , but all this is not enough to protect consumer from the risk of these ads , so the legislator reconsider the sentence imposed for the crime and replaced it of deprivation of liberty in order to add the integrity and legitimacy to transactions between economic assistance and the consumer , and legislator must also in this regard that issuance of a special law regulate announcements and makes ends , he should not overreact to put these controls so that does not hinder this activity.
