النظام الدستوري الجزائري

Abstract

إن الدراسة في طيات النصوص الدستورية والفقهية تظهر كلها الخصوصية التي يتميز بها النظام الدستوري الجزائري، وهذا راجع للخصوصية التي طبق بها مبدأ الفصل بين السلطات، ومزج بين الأنظمة الدستوري التقليدية الأمر الذي نتج عنة تميز لمركز رئيس الجمهورية وجعل منه مفتاح قبة النظام في الجزائر حيث يمارس سلطات الواسعة والتي لا تقتصر على السلطة التنفيذية بالسيطرة الوظيفية والعضوية عليها فحسب بل حتى إلى السلطات التشريعية والذي يعتبر شريك حقيقي في الإنتاج التشريعي والقضائية باعتباره القاضي الأعلى في البلاد، وهذا من خلال الآليات الممنوحة له دستوريا، في مقابل كل هذه الصلاحيات لا يمكن إقرار مسؤولية رئيس الجمهورية .The study on constitutional and jurisprudential texts folds show all privacy of Algerian constitutional system, due to privacy that dish out the principle of separation of powers, blending traditional constitutional systems which resulted in marked for Center President and make him key to the dome system in Algeria where the broad powers which are not limited to the Executive Functional and organic control Executive, but to the legislature, which is considered a real partner in the legislative and judicial production as the supreme judge in the country, and that through the constitutionally granted to him in Exchange for all these powers could not establish the responsibility of the President of the Republic
