نموذج مقترح لسوق أوراق مالية إسلامية تجارب بعض الأسواق المالية الإسلامية وإمكانية التطبيق بالجزائر "دراسة استشرافية"

Abstract

يهدف هذا البحث إلى إقتراح نموذج لإقامة سوق للأوراق المالية بالجزائر تتماشى وفقا لقواعد الشريعة الإسلامية، وذلك من خلال التطرق إلى تجارب بعض الأسواق المالية الإسلامية، ومن تم وضع الأرضية التنظيمية والتشريعية لسوق الأوراق المالية الإسلامية بالجزائر، وبيان أطرافها ومقوماتها، والوقوف على مدى إمكانية تطابق الواقع العملي مع نظرية عملها، والخروج بأهم المعوقات التي تحول دون إقامتها، والتحديات التي تواجهها وفرص نجاحها. ولتحقيق هدف البحث تم اختيار عينتين من المجتمع الجزائري تظم الأولى 104 أشخاص، وتوزعت بطريقة عمدية (مقصودة) على مجموعة من المتخصصين في مجال الاقتصاد الإسلامي، والأسواق المالية والنقدية، ممن لهم درجة الليسانس والماجستير والدكتوراه، والموظفين كأساتذة جامعيين، أو بمؤسسة مالية، عبر التراب الوطني، بينما الثانية تظم 945 شخص، وتوزعت على مجموعة من الأفراد تم اختيارها بطريقة عشوائية حصصية، آخدا بعين الإعتبار المناطق الجغرافية عبر التراب الوطني. خلص البحث إلى أن الجزائر بحاجة ماسة لإقامة سوق للأوراق المالية تتماشى وفقا لقواعد الشريعة الإسلامية، حيث أوصى البحث إلى ضرورة التوجه نحو التمويل الإسلامي، والبحث عن أساليب تمويلية جديدة تلبي متطلبات ومرجعية وخصوصية المجتمع الجزائري المسلم، وذلك من خلال الإستفادة من تجاب الدول الإسلامية السباقة في هذا المجال، وتوفير كل العناصر الشرعية والتنظيمية والمقاصدية لإقامة هذه السوق المنشودة

The aim of this research is to propose a model for the establishment a stock market in Algeria in accordance with the rules of Islamic Shari'a, by addressing the experiences of some Islamic financial markets, and the regulatory and legislative background of the Islamic stock market in Algeria, and representing its parties and elements. Also come up with the most important obstacles and challenges of its creation. In order to achieve the objective of the research, two samples were selected from the Algerian society. The first of which consisted of 104 persons. It was deliberately distributed to a group of specialists in the Islamic economics, financial and monetary markets, who had a bachelor's, master's and doctorate degree and the employees as university professors or financial institutions. While the second consisted of 945 people, it was distributed into a group of randomly selected individuals, taking into account the geographic regions across the national territory. The research concluded that Algeria need of establishing a stock exchange market in accordance with Islamic Shari'a rules. The research recommended the necessity for Islamic finance and the search for new financing methods that meet the requirements and reference of the Algerian Muslim community, by benefiting from the experiences of Islamic countries. Then provide all the legitimate and regulatory elements for making this desired market.
