الضبط الاقتصادي في الجزائر

Abstract

أدت الإصلاحات الإقتصادية التي باشرتها الدولة الجزائرية أواخر ثمانينات القرن الماضي إلى تبني قواعد إقتصاد السوق والمنافسة ، والتي ترتب عليها تغير دور الدولة من دولة متدخلة محتكرة لكل وظائف الإستغلال والتسيير والرقابة إلى الدولة ضابطة تعمل أساسا على إرساء التوازنات الضرورية لممارسة الحريات والأنشطة الإقتصادية ، وكذلك أدت إلى إعادة النظر في الوسائل القانونية للتدخل العمومي، حيث تجلى ذلك خصوصا في إنشاء هيئات ضابطة يصطلح عليها بـ " سلطات الضبط المستقلة أوسلطات الضبط الإقتصادي" لتشرف على القطاعات الإقتصادية المفتوحة على المنافسة ، وجاء إنشاء مثل هذه السلطات ليشكل صورا واقيا ضد التدخلية المباشرة للدولة في عملية التسيير التي تتعارض مع إقتصاد السوق . فسلطات الضبط الاقتصادي في القانون الجزائري وعلى غرار التجارب المقارنة في هذا المجال ، هي استجابة قانونية هامة لسياق اقتصادي يتعلق بالانتقال من الاحتكار العمومي الممارس من طرف الدولة الى المنافسة وحرية السوق.

Les réformes économiques initiées par l' Etat Algérien a la fin des années quatre-vingt de siècle dernier ont abouti a l'adoption des règles de 1’économie de marché et de la concurrence, lesquelles ont engendré le changement du rôle de l’Etat d' un Etat interventionniste monopolisant toute les fonctions d exploitation de gestion et de contrôle, vers un Etat régulateurs qui œuvre principalement a établir les équilibres nécessaire a l'exercice des libres dans les activités économique. Elle ont également conduit a reconsidérer les moyens juridiques d intervention publique .qui se manifeste en particulier dans la mise en place d instance de régulation appelées" autorités de régulation indépendantes" afin de superviser les secteurs économique ouverts sur la concurrence la création de telles autorités est venue formes sur la concurrence la création de telles autorités est venue formes une barrière protectrice contre 1 interventionnisme direct de 1 Etat dans le processus de gestion , qui va a l'encontre de l'économie de marché.
