dc.description.abstract | تكتسي مرحلة المفاوضات في عقود تراخيص براءة الاختراع أهمية بالغة في تحديد معالم العقد، حيث تحتاج الى إدارة استراتيجية وبعد نظر لتحقيق المصالح المرجوة من هذا التعاقد، ونظرا لتفاوت المهارات والقدرات لدى الأطراف المتعاقدة خاصة من جانب الدول النامية الفاقدة للتكنولوجيا، فان وضع مخطط مسبق ومحكم ينضوي على توفير مفاوضين من اعلى مستوى وتحديد الأولويات ونقاط التفاوض يعد حدا فاصلا في تحديد مدى قدرة الدول النامية على إنجاح عقود التراخيص. The negotiating phase of patent license contracts is of paramount importance in the definition of contract parameters, where strategic management and foresight are required to achieve the desired interests of the contract, and because of the different skills and abilities of contracting parties, particularly from developing technology-free States, are required.
