Abstract: الملخص : على الرغم من الأهمية البالغة التي أولتها الحكومات والدول لحماية البيئة من الأضرار التي يسببها الإنسان فوضعت القوانين والاتفاقيات والمعاهدات في معاملاتها مع الدول، وانضمام الجزائر كان محتشم في بادئ الأمر إلا أنها أصبحت الآن مجبرة على الأخذ والتعامل وفق التطورات التكنولوجية الحديثة وكذلك التوسع الاقتصادي والصناعي الجديد للمحافظة على البيئة سواء على المستوى الداخلي للدولة أو على مستوى تعاملاتها في الخارج، فقام المشرع الجزائري بسن العديد من القوانين لحماية البيئة، بحيث توجه إلى الجباية والتي تعد أهم الآليات الاقتصادية الفعالة في حماية البيئة من كل أشكال الضرر، والتي كان يقتصر دورها في البداية في ردع وعقاب الملوثين طبقًا لمبدأ الملوث يدفع، ولما لم يحقق الأهداف المرجوة من خلال هذا الدور توجهت التشريعات الجبائية الجزائرية إلى دور جديد وهو التحفيز، وذلك بعدم فرض الضرائب و الرسوم في حالة ما إذا اعتمدت وسائل تكنولوجية صديقة للبيئة وهذا قبل وقوع الضرر البيئي، وعائدات هذه الجباية التي يتم تحصيلها ترفع من إيرادات الدولة من أجل حماية البيئة، فهي تخصص لمكافحة التلوث وذلك بتعويض ضحايا التلوث، أو تمويل المؤسسات التي تعنى بحماية البيئة وبالتالي إيرادات البيئة تخصص لتغطية نفقاتها، كما يتم تمويل البحوث المتعلقة بمكافحة البيئة، كما أن الجباية البيئية تحفز وتشجع المتسببين بالتلوث للبحث عن الأساليب التكنولوجية الحديثة الأقل تلوثًا واستخدام الوسائل الصديقة للبيئة، فالدولة هنا تحقق ربح مزدوج فمن ناحية تزداد الإيرادات ومن ناحية أخرى تحصل الدولة على بيئة سليمة خالية من التلوث.
Résumé: Malgré la grande importance que les gouvernements et les États attachent à la protection de l'environnement contre les dommages causés par les êtres humains, des lois, des accords et des traités ont été mis en place dans leurs relations avec les États, et l'adhésion de l'Algérie a été modeste au début, mais elle est maintenant obligée de prendre et de faire face aux développements technologiques modernes ainsi qu'à la nouvelle expansion économique et industrielle de la province. Sur l'environnement, que ce soit au niveau interne de l'Etat ou au niveau de ses relations à l'étranger, le législateur algérien a promulgué de nombreuses lois pour protéger l'environnement, de sorte qu'elles étaient orientées vers la fiscalité, qui est le mécanisme économique efficace le plus important pour protéger l'environnement de toutes formes de dommages, et dont le rôle était limité au départ pour dissuader. Punir les pollueurs se fait selon le principe du pollueur-payeur, et quand elle n'a pas atteint les objectifs souhaités à travers ce rôle, la législation fiscale algérienne est passée à un nouveau rôle, qui est la motivation, en n'imposant pas de taxes et de redevances dans le cas où des moyens technologiques respectueux de l'environnement seraient adoptés et ceci avant la survenance des dommages environnementaux, et le produit de cette collecte Ce qui est collecté augmente les revenus de l’État afin de protéger l’environnement. Il est dédié à la lutte contre la pollution en indemnisant les victimes de la pollution ou en finançant Parce que les institutions concernées par la protection de l'environnement et donc les revenus de l'environnement sont allouées pour couvrir leurs dépenses, et la recherche liée à la lutte contre l'environnement est également financée, et la collecte environnementale motive et encourage les pollueurs à rechercher des méthodes technologiques modernes moins polluantes et l'utilisation de moyens respectueux de l'environnement, car l'État réalise ici un double bénéfice. D'autre part, l'Etat obtient un environnement sain et exempt de pollution.
Summary: Despite the great importance that governments and states attach to protecting the environment from damage caused by humans, laws, agreements and treaties have been put in place in their relations with states, and the Algeria's membership was modest at first, but it is now forced to take and cope with modern technological developments as well as the new economic and industrial expansion of the province. On the environment, whether at the internal level of the State or at the level of its relations abroad, the Algerian legislator has promulgated many laws to protect the environment, so that they were oriented towards taxation. , which is the most important effective economic mechanism to protect the environment from all forms of damage, and whose role was initially limited to deterrence. Punishing polluters is done according to the polluter pays principle, and when it has not achieved the desired objectives through this role, Algerian tax legislation has moved to a new role, which is motivation, by not imposing of taxes and royalties in the event that environmentally friendly technological means are adopted and this before the occurrence of environmental damage, and the proceeds of this collection What is collected increases State revenues in order to protect the environment. It is dedicated to the fight against pollution by compensating the victims of pollution or by funding Because the institutions concerned with the protection of the environment and therefore the environmental revenues are allocated to cover their expenses, and related research the fight against the environment is also funded, and environmental collection motivates and encourages polluters to seek modern technological methods that are less polluting and the use of means that respect the environment, because the State achieves a double benefit here. On the other hand, the state obtains a healthy environment free from pollution.
