Equality of investments: Between the explicit declaration as guarantee and the implicit concealment as restriction

Abstract

The purpose of thisstudyis to high light the equalitybetweeninvestors,inorder to bringtheir money to beinvested in Algeria, according to the Law 16/09, Art.21 related to Investment, stipulates an equitabletreatmentwith regard to the rights and obligations attached to theirinvestments. This guaranteerequires the necessity of not makinganytrade-offsbetween the national and foreigninvestor. The legislativemaneuvers and the fanaticism of national sovereigntymayexplicitlyrestrictthisguarantee, and stand in the way of it, and this is what leads to the freezing of the rules of economicgovernance
