The crime of verbal and psychological violence against the wife in the Algerian and Iraqi legislation

Abstract

The dangers of verbal and psychological violence angainst the wife and family, pushed the criminal legislator to intervene criminalizing and punishing for it, hence this research aims to identify the acts that represent a crime of verbal and psychological violence against the wife, in addition to the procedures, and the penalties prescribed for this crime. This research raises the following problem: How did the Algerian and Iraqi criminal legislator treat the crime of verbal and psychological violence against the wife, and does these guarantee the protection of the family? Through this research, we reached a number of results, the most important of them are: relying on the text of criminalization and punishment alone will not achieve its purpose, because this crime is linked to ideas, customs and social norms that prevent criminal texts from achieving their goals. Rather, an integrated strategy must be developed, with the participation of the various concerned government sectors, human rights associations, imams, educational institutions, and means of communication, in order to remove all the obstacles
