الآليات القانونية لحماية البيئة من التلوث الصناعي

Abstract

الملخص : هدفت هذه الدراسة إلى معرفة مجمل الآليات القانونية لحماية البيئة من التلوث الصناعي، حيث حاولنا التطرق إلى المعنى العام للتلوث الصناعي مع إبراز أهم أنواعه وآثاره، ومن هذا المنطلق تم لتناول أهم الآليات الوقائية والعلاجية التي سنها المشرع الجزائري والتي من خلالهاأقر بجملة من التدابير القبلية والبعدية كما تم الإشارة إلى المسؤولية الجزائية والمدنية اتجاه صاحب المشروع الصناعي. وبناءاً على ذلك تم التوصل إلى عدة نتائج أبرزها أن المشرع الجزائري أولى أهمية بالغة لحماية البيئة من خلال عدة قوانين أهمها قانون 03 /10 المتعلق بحماية البيئة في إطار التنمية والمستدامة الذي ساهم في تجسيد آليات الحماية.

Résumé: Cette étude visait à connaître les mécanismes juridiques de protection de l'environnement contre la pollution industrielle. Où nous avons essayé d'aborder le sens général de la pollution industrielle، en soulignant ses types et effets les plus importants. De ce point de vue، les mécanismes préventifs et curatifs les plus importants édictés par le législateur algérien، à travers lesquels il a approuvé un ensemble de mesures tribales et dimensionnelles، ont été abordés. La responsabilité pénale et civile du propriétaire du projet industriel a également été indiquée. En conséquence، plusieurs résultats ont été atteints، notamment que le législateur algérien a attaché une grande importance à la protection de l'environnement A travers plusieurs lois dont la plus importante est la loi 10/03 relative à la protection de l'environnement dans le cadre du développement durable، qui a contribué à la concrétisation des mécanismes de protection.

Abstract: The objective of this study was to learn the totality of the legal mechanisms for protecting the environment from industrial pollution. We tried to show the general meaning of industrial pollution with the presentation of its most important types and effects, From this point of view, We have reviewed the most important preventive and remedial mechanisms enacted by the Algerian legislator. He has devoted a series of tribal and subsequent measures, and reference has been made to the penal and civil liability of the industrial project owner. Accordingly, several conclusions have been reached, the main one is the fact that Algerian legislator attaches great importance to the protection of the environment through several laws The most important is Act No: 03/10 on environmental protection in the context of development and sustainability, which has contributed to the strengthening of protection mechanisms
