الضوابط القانونية لحرية الإعلام

Abstract

الملخص : نلخص من خلال دراستنا هذه تعتبر حرية الإعلام من أهم الركائز التي تقوم عليها المجتمعات إلا أنه يجب أن تخضع هذه الحرية إلى مجموعة من الضمانات والقيود التي تحميها إذا قامت المواثيق الدولية و الاعلانات على ضمان حرية الرأي و التعبير و حق الصحفي في نشر المعلومات و الأفكار ونقلها بأية وسيلة كانت ،و لقد كان النشاط الإعلامي في ظل الاحادية الاعلامية محتكرا من طرف الدولة حيث عرف قطاع الإعلام في مرحلة التعددية الحزبية إنفتاح جراء التحولات الجدرية والاصلاحات التي طرأت عليه و بناء على هذا أصبحت حرية التعبير مكرسة دستوريا و قانونيا في دساتيرها المتعاقبة التي أقرات حرية الرأي و التعبير و بعد صدور قانون الإعلام رقم 05/12الذي رفع الاحتكار الدولة و فتح المجال أمام الخواص فقد كرس هذا القانون من الجانب التنظيمي جملة من تشريعيات التي نصها صراحة في قانون الإعلام الذي وضع أحكام تنظيمية و إجرات تمكن الإعلامي في الحق للوصول الى حرية الرأي و التعبير و الحفاظ عى النظام العام و الأحكام سلطة ضبط الصحافة المكتوبة و السمعي البصري و الصحافة الإلكترونية وخول لها مهام لمراقبة قطاع الإعلامي لما له من تاثير على الرأي العام.

Résumé : A partir de cette étude on remarque que la liberté de médias est parmi les importances qui la sociétébasé sur elle, plus de ça elle doive est un sujet d'ensemble des garanties et de limitations, que on peut le protégés. Si les conventions et les déclarations internationales sont fondées sur la garantie de la liberté d'opinion et d'expression, et le droit de journaliste de publier ses information et idées. L'activité médiatique était l'ombre de conversation informatique de part de l'état, là où le secteur de médias dans la phase de pluralisme partiel a connu l'ouverture en raison de changement radicaux. Sur cette base, la liberté d'expression est devenue constitutionnellement et légalement inscrite dans ses constituions successives. Après la promulgation de loi N° 05/12, qui ouvret la voie au privé, qu'il consacrés du coté règlementaire un certain nombre de légalisation. La liberté d'opinion et ces dispositions étaient soumises à l'autorité de contrôle de la presse écrite, audiovisuelle et électronique

Abstract : We summarize through this study, media freedom is one of the most important pillars on which societies are based. By all means, and media activity in the light of media unilateralism was monopolized by the state, where the media sector in the multiparty phase experienced openness as a result of the radical transformations and reforms that took place. took place there and on the basis of this freedom of expression became constitutionally and legally enshrined in its successive constitutions which endorsed freedom of opinion and expression After the promulgation of the Media Law No. 12/05, which lifted the state monopoly and paved the way for the private sector, this law enshrined on the organizational side a number of legislations which explicitly stipulated in the law on the media, which set out organizational provisions and procedures allowing the media to have the right of access to freedom of opinion Expression and the maintenance of public order and supplies The authority for the control of the written, audiovisual and electronic press ctronics and empowered them to monitor the media sector because of its impact on public opinion.
