الضبط الإداري البيئي في التشريع الجزائري

Abstract

ملخص الدراسة: تشكل التجاوزات التي تحدثها نتائج مختلف الأنشطة البشرية وما تلحقه بالبيئة من أضرار، أحد أهم المشاكل التي تواجه العالم أجمع.ونتيجة لتداعيات هذه المخاطر البيئة على الأوضاع في الجزائر، نجد أن الدولة الجزائرية سارعت إلى تبني حتمية حماية البيئة نتيجة التجاوزات المسجلة بهذا الشأن، وذلك عبر سلطاتها الإدارية المختصة على المستوى المركزي واللامركزي مزودة بآليات قانونية سهر على سنها المشرع الجزائري، تمكنها من أداء مهامها في مجال حماية البيئة، والتي تتوخى من خلالها البعد الوقائي كخطوة احترازية تحول دون وقوع الاعتداء البيئي والبعد الردعي كإجراء علاجي لوقف مخالفاتأحكام قوانين حماية البيئة. الإشكالية:نظرا لما تبديه الدولة الجزائرية من مجهودات للاهتمام بالبيئة وضرورات حمايتها،تطرقنا من خلال هذه الدراسة إلى البحث في الإشكالية التالية: كيف ساهم الضبط الاداري البيئي في حماية البيئة؟

Abstract : The encroachments caused by the different human activities, and their damages to the environment, are one of the most significant problems faced by the whole world. As a result of the repercussions of such environmental risks in Algeria, the Algeria state acted promptly to adopt the inevitability of environment protection against the encroachments witnessed in this regard. This wad by means of its special administrative authorities at both levels: central and non-central, provided with legal mechanisms safeguarded by the Algerian legislator, enabling it to perform its tasks in the scope of environment protection. The aim behind this underlies in the preventive dimension as a precautionary step without falling in the environmental violation, and the deterrent dimension as a treatment procedure to halt the environment protection laws provisions violation.

Research problem: further to what the Algerian state shows as efforts to look after environment and its protection necessities, we have addressed in this study the following research question: How has the environmental administrative control contributed to environment protection?

Résumé : Les empiétements causés par les différentes activités humaines, et leurs dommages à l’environnement, sont l’un des problèmes les plus importants rencontrés par le monde entier. En raison des répercussions de ces risques environnementaux en Algérie, l’État algérien a agi promptement pour adopter l’inévitabilité de la protection de l’environnement contre les empiétements constatés à cet égard. Cela passe par ses autorités administratives spéciales aux deux niveaux : central et non central, dotées de mécanismes juridiques sauvegardés par le législateur algérien, lui permettant d’accomplir ses tâches dans le cadre de la protection de l’environnement. L’objectif sous-jacent est la dimension préventive comme mesure de précaution sans tomber dans la violation de l’environnement, et la dimension dissuasive comme une procédure de traitement pour mettre fin à la violation des lois de protection de l’environnement.

La Problématique: suite à ce que l’Etat algérien montre comme des efforts pour s’occuper de l’environnement et de ses nécessités de protection, nous avons abordé dans cette étude la question de recherche suivante : Comment le contrôle administratif environnemental a-t-il contribué à la protection de l’environnement?
