ملخص: يعد مبدأ حرية الإثبات في القانون التجاري مظهر من مظاهر النظام الحر، من خلال ما تتسم به الحياة التجارية من مميزات خاصة تختلف عن القواعد المألوفة في القانون المدني، وهذا راجع لتأثر الحياة التجارية بعاملي السرعة والائتمان التي تتطلبها المعاملات التجارية. فمبدأ حرية الإثبات في القانون التجاري، يسمح بإثبات الأعمال التجارية بكافة الوسائل، بما في ذلك شهادة الشهود والدفاتر التجارية وهذه الأخيرة بينا مدى حجيتها أمام القضاء أو أي وسيلة مناسبة لإثبات دعواه إذا تبين للقاضي وجوب قبولها. لكن فرضت قيود على هذا المبدأ إما بقوة القانون أو اتفاق الطرفين.
