الحماية الجزائية للمعطيات الشخصية في ظل القانون 18/07.

Abstract

الملخص: تعتبر المعطيات الشخصية جزء من الحياة الخاصة للأفراد، والتي دعت جل الاتفاقيات الدولية إلى حمايتها، لا سيما بعد التطور التكنولوجي وما افرزه من تقنيات حديثة ساعدت على سرعة تداول المعلومات، الأمر الذي دفع إلى ضرورة التحرك من أجل تحقيق توازن بين الحق في تداول المعلومة وحماية الحق في الخصوصية. في هذا السياق أصدر المشرع الجزائري قانون 18/07 المتعلق بحماية المعطيات الشخصية، والهدف منه تأطير الحماية القانونية للحياة الخاصة للأفراد والحفاظ على سمعتهم وشرفهم وكرامة عائلاتهم، والذي يشترط الموافقة الصريحة للشخص المعني لاستعمال معطياته الشخصية تماشيا مع مبادئ الدستور الجزائري. تناول هذا القانون من خلال مواده المبادئ الأساسية لحماية المعطيات ذات الطابع الشخصي والتي تسهر على تطبيقها السلطة الوطنية لحماية المعطيات ذات الطابع الشخصي، حيث تتمتع هذه الأخيرة بمجموعة من الصلاحيات تسمح لها بتطبيق أحكام جزائية للحفاظ على خصوصية المعطيات الشخصية.

Résumé : Les données personnelles sont Considérées comme une partie de la vie privée des personnes, qui doit être protéger en priorité et en particulier après le développement technologique et des techniques modernes a permis la circulation de la vitesse de l’information, ce qui a incité la nécessité de se déplacer afin de parvenir à un équilibre entre le droit à l’échange d’informations et à la protection de la vie privée et de bon ordre public. Dans ce contexte on trouve la publication de la loi 18/07 publier par le législateur algérien contenant la protection des données personnelles, et l’objectif d’encadrer la protection juridique des vies des individus et de maintenir leur réputation, honneur et dignité ainsi de leurs familles, ce qui nécessite le consentement exprimer de la personne concernée pour l’utilisation de ces données conformément aux principes de la Constitution algérienne. Cette loi visait à travers les articles de principes fondamentaux pour la protection des données à caractère personnel qui veille à l’application de l’autorité nationale de protection des données personnelles,lorsque celle-ci a un éventail de pouvoirs pour leur permettre d’appliquer des dispositions pénales et à maintenir la confidentialité des données personnelles.

Abstract: Personal data is part of the privacy of individuals, which most international agreements called for protection, especially after the technological development and modern technologies that have resulted, which have accelerated the circulation of what has led to the need for move towards a balance between the right to the flow of information and the protection of the right to privacy. In this context, the Algerian legislator promulgated the law No. 18/07 relating to the protection of the personal data, whose goal is to frame the legal protection of the private life of the individuals and the preservation of their reputation, honor and dignity their families, which requires the person’s explicit consent to the person using their personal data in accordance with the principles of the Algerian constitution. This law deals through its articles with the basic principles for the protection of personal data, that the National Authority for the Protection of Personal Data Guaranteed, that the latter has a set of powers enabling it to request criminal provisions to preserve the confidentiality of personal data.
