Abstract

الملخص: يعد توفير الحماية لقرينة البراءة أحد أهم الوجبات التي تقع على عاتق الدولة تحديدا السلطة القضائية ، من خلال إتباع جملة من الضوابط القانونية بهدف تجسيد هذا المبدأ المعترف به في جل المواثيق الدولية والإعلانات العالمية لحماية حقوق الانسان وحرياته، يبدو أن السبب وراء هاته العناية الدستورية تعود لتعرض المبدأ لخطر حقيقي مؤداه المادة11ف3 من ق.إ.ج التي رخصت لأجهزة الإعلام تغطية أخبار المحاكمات ونشر إجراءاتها ماسا بذلك ومتعارضا مع قرينة البراءة وكل ما ينبثق عنها من حقوق. وهو ما يدعونا إلى التعمق في مسألة الضوابط القانونية لتحقيق الحماية الكافية عند ممارسة الإعلام لحقه في الصحافة وحرية الرأي والتعبير عند نقل أخبار الجرائم، غير أن هذا لا يعني إطلاقا تقييد الحريات المكفولة دستوريا لمزاولة نشاط الاعلام وإنما هو ضمانة وضابطا، ففي الحقيقة تأطير نشاط الاعلام لتغطية الأخبار بشكل نزيه وحيادي يعزز قيم العدالة والمساواة ، وفي ذات الوقت نفسه يبقى الحق في قرينة البراءة قائما إلى أن يثبت بحكم قضائي بات دون الميل المسبق نحو انعدامه دون مسوغ.
