Abstract

الملخص: تعتبر الصفقات العمومية عقود مكتوبة تبرمها الإدارة بصفتها المصلحة المتعاقدة مع المتعامل الاقتصادي لأجل تلبية حاجياتها وهي الوسيلة المثلى التي تمكن السلطة العامة من استغلال الأموال العامة، ونظرا لارتباط هذه الأخيرة بالخزينة العمومية جعلها معرضة للفساد والتلاعب ولذلك فقد أخضعها المشرع الجزائري لجملة من الرقابة من أجل حماية المال العــــــــــــــــــام ، وتمثلت في الرقابة الداخلية التي تمارسها لجنة فتح الأظرفة وتقييم العروض والرقابة الخارجية التي تمارسها لجان المصلحة المتعاقدة واللجنة القطاعية خلال مرحلة إبرام الصفقات العمومية وصولا إلى تحقيق الأهداف المسطرة ..
