التسرب في التشريع الجزائري

Abstract

الملخص: يعد التسرب أسلوبا جديدا من أساليب التحري الخاصة ، التي استحدثها المشرع الجزائري في ميدان التحقيق لمكافحة أنواع معينة من الجرائم, التي تتسم بالخطورة والتعقيد والمحددة قانونا وذلك بموجب القانون رقم 06-22 المؤرخ في 20 سبتمبر 2006 المعدل والمتمم للأمر رقم 66-155 المتضمن قانون الإجراءات الجزائية, وهو عمل ميداني يقوم به ضابط الشرطة القضائية أو أحد أعوانه تحت مسؤولية ضابط شرطة القضائية المكلف بتنسيق العملية,في ظل احترام شروط شكلية وموضوعية وتحت رقابة الجهات القضائية مانحة الإذن به, والمتمثلةفي وكيل الجمهوريةأو قاضي التحقيق بعد إخطار وكيل الجمهورية, مع ضمان حماية قانونية للمتسرب أثناء و بعد العملية, و تهدف هذه العملية إلى اختراق صفوف الجماعات الإجرامية, بإيهامهم أنه فاعل معهم أو شريك لهم أو خاف لأدلةالإثبات الجنائي لديهم، وهذا من أجل إيقافهمو وضع حد لنشاطهم الإجرامي وتقديمهم أمام الجهات القضائية.

Résumé: L'infiltration est une nouvelle méthode d'investigation spéciale introduit par le législateur algérien dans le domaine de l'investigation pour lutter contre certains types de crimes. Ce qui est dangereux, complexe et légalement défini par la loi n° 06-22 du 20 septembre 2006 modifiant et complétant l'ordonnance n 155-66 portant code de procédure pénale. Il s'agit d'un travail de terrain effectué par l'officier de police judiciaire ou l'un de ses adjoints sous la responsabilité de l'officier de police judiciaire chargé de coordonner l'opération. Sous réserve du respect des conditions formelles et objectives et sous le contrôle des autorités judiciaires qui ont accordé l'autorisation qui est représenté par le procureur de la République ou le juge d'instruction après notification au procureur de la République tout en assurant la protection juridique du bailleur pendant et après la procédure d' infiltration. Cette opération vise à infiltrer les rangs des groupes criminels en leur faisant croire qu'il est un acteur important, un partenaire important, ou un effaceur de leurs preuves criminelles. Ceci afin de les arrêter et de mettre fin à leur activité criminelle et de les traduire devant les autorités judiciaires

Abstract : Infiltration is a new special investigation method introduced by the Algerian legislator in the field of investigation to combat certain types of crimes which is dangerous, complex and legally defined by Law No. 06-22 of September 20, 2006 amending and supplementing Ordinance No. 155-66 containing the Code of Criminal Procedure. It is a field work carried out by the judicial police officer or one of his assistants under the responsibility of the judicial police officer in charge of coordinating the operation in light of respecting the formal and objective conditions and under the supervision of the judicial authorities that granted permission which is represented by the public prosecutor or the investigative judge after notifying the public prosecutor while ensuring legal protection for the infiltrator during and after the infiltration process. This operation aims to infiltrate the ranks of criminal groups by deluding them that he is an important actor, an important partner, or eraser of their criminal evidence in order to stop them and put an end to theircriminal activity and bring them to the judicial authorities.
