إعادة النظر في نظام الإفلاس في القانون التجاري الجزائري

Abstract

يلعب نظام الإفلاس دورا أساسيا في حماية السرعة والائتمان في المعاملات التجارية ولذلك كان هدف هذه الدراسة هو تقييم نظام الإفلاس في القانون التجاري الجزائري وإبراز مدى فاعليته مقارنة بالتشريعات المقارنة التي قامت بتحديث قوانينها مسايرة للتغيرات الاقتصادية العالمية ووفقا للتوجهات الجديدة لقوانين الإفلاس الحديثة القائمة على إنقاذ المشروعات المتعثرة. وقد تم التوصل من خلال هذه الدراسة إلى قصور نظام الإفلاس الذي تبنته الجزائر منذ سنة 1975 بسبب تركيزه على تصفية أموال المدين وتوزيعها على دائنيه بدلا من إنقاذه مما يقتضي تحديث هذا النظام لينسجم مع التحولات الاقتصادية الكبرى التي عرفتها الدولة.

The bankruptcy system plays an essential role in protecting the speed and security of business transactions. Therefore, the objective of this study is to evaluate the bankruptcy system In the Algerian commercial law and to highlight its effectiveness compared to the comparative legislations that have updated the law In line with global economical changes and In accordance with the new trends of modern bankruptcy laws based on saving troubled projects. Through this study it has been found that the bankruptcy system adopted by Algeria since 1975 has shortcomings because of its focus on liquidating the debtor’s funds and distributing them to his creditors Instead of saving him. This requires updating this system to be consistent with the major economical transformations that the state has known.
