تجسيد مبدأ الشفافية في الصفقات العمومية في ظل التشريع والتنظيم الجزائريين

Abstract

ملخـــــص لقد كرس المرسوم الرئاسي رقم: 247 -15 جملة من المبادئ التي تحكم الصفقات العمومیة وتفویضات المرفق العام و التي تتمثل أساسا في حریة الوصول للطلبات العمومیة والمساواة في معاملة المرشحین وشفافیة الإجراءات والتي يتوجب احترامها من طرف كل المصالح المتعاقدة أثناء تلبیة حاجاتها سواء في مجال الأشغال واللوازم أو الخدمات و الدراسات، من أجل ضمان نجاعة للطلبات العمومیة والاستعمال العقلاني للأموال العمومیة. ویعتبر مبدأ الشفافیة موضوع البحث من أهم الآلیات التي یقوم عليها الحكم الراشد في مختلف الإدارات العمومیة، لذلك فإن التنظیم الجدید للصفقات العمومیة حرص على وضع مجموعة من الإجراءات والضوابط المكرسة والمدعمة للمبدأ عبر كل مــــراحل إعداد الصفقة .

Résumé : Le décret présidentiel n° 15-247 consacre un ensemble de principes régissant les accords ,les mandats d ʹutilité publique ,que consistent principalement en un accès gratuit aux demandes généralité ,égalité de traitement des candidats et transparence des, qui doivent être respectés par tous les intérêts contractants lors de l accomplissement de leurs besoins que ce soit dans le domaine des travaux et fournitures ou des services et études ,afin dʹ assurer lʹefficacité du public demandes et lʹutilisation rationnelle des fonds publics. Le principe de transparence est considéré comme lʹun des mécanismes les plus importants sur lesquels repose la bonne gouvernance dans les différences administrations publique.
