السلطة الوطنية المستقلة للانتخابات ودورها في العملية الانتخابية من خلال القانون العضوي 19-07

Abstract

الملخص: أنشأ المشرع الجزائري السلطة الوطنية المستقلة للانتخابات بموجب القانون العضوي رقم 19-07 المؤرخ في 14/09/2019 من أجل ضمان نزاهة وشفافية العملية الانتخابية الذي طالبت به الأحزاب السياسية والحراك الشعبي ل 22 فبراير 2019 وفي ظل ظروف سياسية خاصة، حيث منحها صلاحيات واسعة في تسيير العملية الانتخابية بدء من تحضير الانتخابات وتنظيمها وإدارتها والإشراف عليها، أي ابتداء من عملية التسجيل في القوائم الانتخابية ومراجعتـها، مرورا بكـل عمليـات تحضيـــر الانتخابات وإجراءات التصويـت والفرز والبت في المنازعات الانتخابية إلى غاية إعلان النتائج الأولية وصولا إلى التحقق من مدى فعالية الصلاحيات الممنوحة للسلطة ومدى استقلاليتها الإدارية والمالية، وكذلك الصلاحيات التي تضمن لها الحياد عن جميع الأطراف المشاركة في العملية الانتخابية. كل ذلك من أجل الوصول إلى تجسيد وتعميق الديمقراطية الدستورية وترقية النظام الانتخابي وذلك لتكريــس مبــدأ سيــادة الشعــب عــن طريــق انتخابات حــرة ونزيهــة وشفافة وتحقيق الشرعية والديمقراطية في إطار دولة القانون

Abstrait : Le législateur algérien a institué l'Autorité électorale nationale indépendante en vertu de la loi organique n°19-07 du 14/09/2019 afin d'assurer l'intégrité et la transparence du processus électoral exigées par les partis politiques et le mouvement populaire le 22 février 2019 et dans des circonstances politiques particulières, Il lui a conféré de larges pouvoirs dans la conduite du processus électoral, à commencer par la préparation, l'organisation, la gestion et la supervision des élections, c'est-à-dire depuis le processus d'inscription sur les listes électorales et leur examen, à travers toutes les processus de préparation des élections, procédures de vote, dépouillement et règlement des litiges électoraux jusqu'à l'annonce des résultats. Primaire Afin de vérifier l'effectivité des pouvoirs conférés à l'autorité et l'étendue de son indépendance administrative et financière, ainsi que les pouvoirs qui lui garantissent l'impartialité de toutes les parties participant au processus électoral. Tout cela dans le but de réaliser l'incarnation et l'approfondissement de la démocratie constitutionnelle et la promotion du système électoral afin de consolider le principe de la souveraineté du peuple à travers des élections libres, justes et transparentes et d'atteindre la légitimité et la démocratie dans le cadre de l'état de droit

Abstract : The Algerian legislator established the Independent National Electoral Authority by virtue of Organic Law No. 19-07 of 14/09/2019 in order to ensure the integrity and transparency of the electoral process demanded by political parties and the popular movement on February 22, 2019 and under special political circumstances,It granted it wide powers in running the electoral process, starting with the preparation, organization, management and supervision of the elections, that is, from the process of registering in the electoral lists and reviewing them, through all the processes of election preparation, voting procedures, counting and deciding electoral disputes until the announcement of the results. PrimaryIn order to verify the effectiveness of the powers granted to the authority and the extent of its administrative and financial independence, as well as the powers that guarantee it impartiality from all parties participating in the electoral process. All of this is in order to achieve the embodiment and deepening of constitutional democracy and the promotion of the electoral system in order to consolidate the principle of the sovereignty of the people through free, fair and transparent elections and to achieve legitimacy and democracy within the framework of the rule of law.
