Abstract: A Legal And A Jurisprudent Conflict Happened With the formula creating the disposition of waqf called (sighah),whether waqf can be perpetuity or temporary. It is noteworthy that waqf properties have historically encountered a set of social circumstances that resulted in their dwindling . Such waqf properties have been abandoned and encroachment by individuals and ruling regimes, which led the owners to avoid waqf of their movable and immovable funds. All these reasons founded for the temporary waqf that has been adopted by most legislations, it serves any property owners to give temporarily what they can give as waqf, it also serves the beneficiaries of waqf the possibility of benefiting from certain endowments and services which cannot be granted to them by adopting the perpetuity of the waqf. The temporary Waqf is the optimal solution for the various contemporary economical and social problems encountered in the Muslim community.
