Abstract

ملخص أطروحة الدكتوراه لاشك في أن الجريمة المنظمة تبوأت في العالم مكانة مشهودة جعلتها تتصدر أهم مشكلات العصر الحديث اهتماما، من طرف صناع القرار أو فقهاء القانون الجنائي خاصة لما لها من تأثير خطير على الاستقرار العالمي . لقد تطورت الجريمة في عصرنا الحالي تطورا ملحوظا من إجرام عادي إلى إجرام منظم لا يحده حدود واستفاد هذا التطور من قفزات تكنولوجيا مذهلة في شتى المجالات بصفة عامة وفي مجال الاتصالات بصفة خاصة والمواصلات بمختلف أنواعها،بحيث أصبح العالم قرية صغيرة وطويت المسافات ولم يعد لها أي اعتبار ،فساعد ذلك في تطور الجريمة المنظمة وسرعة انتشارها وأصبحت عابرة للقارات.

فمنذ نهاية القرن التاسع عشر وبداية القرن العشرين عرفت أوروبا نزوحا كبيرا نحو أمريكا مما أدى إلى انتقال المافيا الايطالية إلى أمريكا وهي الفترة التي هاجر فيها ملاين الايطاليين إلى أمريكا ، وشكلت هناك عائلات معروفة بالإجرام وصدرت لها أفكارها المعروفة كالولاء للعائلة أو للزعيم مؤسسها وقوانينها التي تحكمها كقانون الصمت المشهور، لكن هذا الولاء للعائلة أو لزعيمها لم يعد هو المؤثر والمنظم لشؤونها بل تأثر ذلك بموجة العولمة.

لقد سمح ذلك في انتقال المنظمات الاجرامية من مهد العائلة إلى العالمية فتغيرت المصطلحات من المافيا إلى الجريمة المنظمة العابرة للحدود متى توفرت فيها جملة من الخصائص وفصلها عن المعتقدات السابقة للمافيا بالشكل الكلاسيكي،والذي خلصت إليه العديد من المؤتمرات الدولية التي تبلورت فيها تلك الخصائص إلى غاية صدور اتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة وأصبحت المرجعية العالمية لها.

وتهدف دراستنا لموضوع "آليات مكافحة الجريمة المنظمة" لتوضيح هذه الآليات ومحاولة لجمعها وبيانها كمحاولة فقهية وعلمية لإرساء نظرية عامة تحكم هذه الآليات خاصة في ظل توجه المشرع الجنائي الجزائري لإتباع نظيره الفرنسي في المواجهة غير المباشرة للجريمة المنظمة التي سنتطرق إليها بالتفصيل وبالتالي يصبح من العسير استخراج أغلب الآليات ووضعها في قالب علمي نظري مدروس وهذا في رأي من الصعوبات العلمية التي واجهتنا في الإلمام بهذا الموضوع والإحاطة به في مختلف جوانبه العلمية.

Résumé : Il ne fait aucun doute que le crime organisé a assumé une position de premier plan dans le monde qui en a fait l'avant-garde des problèmes les plus importants de l'ère moderne, par les décideurs ou les juristes du droit pénal, notamment en raison de son grave impact sur la stabilité mondiale. La criminalité à notre époque actuelle a remarquablement évolué du crime ordinaire au crime organisé qui n'a pas de frontières, et cette évolution a bénéficié de sauts technologiques étonnants dans divers domaines en général, et dans le domaine des communications en particulier et des transports de toutes sortes, de sorte que le monde est devenu un petit village et les distances se sont raccourcies, et n'ont plus aucune considération. , Cela a contribué au développement et à la propagation rapide du crime organisé, qui est devenu intercontinental.

Depuis la fin du XIXe siècle et le début du XXe siècle, l'Europe a connu un important exode vers l'Amérique, qui a conduit au transfert de la mafia italienne vers l'Amérique, une période au cours de laquelle des millions d'Italiens ont immigré en Amérique. Crime in our current era has evolved remarkably from ordinary crime to organized crime that has no borders, and this development has benefited from astonishing technological leaps in various fields in general, and in the field of communications in particular and transportation of all kinds, so that the world has become a small village and distances have been shortened, and no longer have any consideration. , This helped in the development and rapid spread of organized crime, which became intercontinental.

Since the end of the nineteenth century and the beginning of the twentieth centuryEurope experienced a large exodus towards America, which led to the transfer of the Italian mafia to America, a period in which millions of Italians immigrated to America.Families known for criminality were formed there, and their well-known ideas were issued to them, such as loyalty to the family or to the leader of its founder and its laws that govern it, such as the famous law of silence, but this loyalty to the family or to its leader is no longer the one influencing and organizing its affairs, but rather this was affected by the wave of globalization.
