خصوصية التحقيق والمحاكمة في جرائم الأحداث في التشريع الجزائري

Abstract

ملخص اهتماما بفئة من الفئات العمرية المرتكبة للجرائم التي تسمى بالأحداث الجانحين عهد المشرع الجزائري إلى اعتماد سياسة جنائية يحمي بها هذه الفئة عبر مراحل سنية باستحداث جهات خاصة بمحاكمتهم واتخاذ قواعد وأحكام إجرائية في مجال التحقيق والمحاكمة وصولا إلى تدابير حماية وتهذيب بدلا من العقاب وذلك بموجب قانون 15/12 المتعلق بحماية الطفل الجانح

Abstract : Concerned with a group of age groups that commit crimes called juvenile delinquents, the Algerian legislator entrusted the adoption of a criminal policy to protect this group through age stages by creating special bodies to try them and adopt procedural rules and provisions in the field of investigation and trial, leading to measures of protection and discipline instead of punishment, according to Law 15/ 12 related to the protection of the delinquent

résumé : Préoccupé par un groupe de tranches d'âge qui commettent des délits appelés délinquants juvéniles, le législateur algérien a confié l'adoption d'une politique pénale pour protéger ce groupe à travers les tranches d'âge en créant des organes spéciaux pour les juger et adopter des règles de procédure et des dispositions en matière d'enquête et de procès, débouchant sur des mesures de protection et de discipline au lieu de punition, conformément à la loi 15/12 relative à la protection de l'enfant délinquant .
