Abstract

ملخص: عقد الهبة للأعضاء البشرية هو أن الشخص البالغ يقوم بالتبرع بعضو من أعضاه لشخص الأخرالذي هوفي أشدالحاجة إلى هذاالعضو،وهذايتمبدون مقابل وبرض اتام من المتبرع وقبول من المتلقي،وقد وجدت هذه العملية انتقاد واختلاف بين الشرائع والفقه والشريعة الإسلامية ،فهناك من يبيح هذه العملية بينمايوجد من يرفض ذلك وكلهما كان له أدلة مقنعة لآرائهم وفقضوابطو أحكام، ولكي يتم انعقادهذ االعقد يجب أن يتوافر على جميعالأركان العامة كماهوالحال في باقي العقود، أما بخصوص مسألة الرجوع في الهبة فإنه لايجوز الموافقة عليها إلا بعذر مقبول ويمنع ذلك إلاممن يحق له ذلك وفقل لقانون،كما نشير إلى أنه من يقوم بمخالفةالضوابط القانونية فالمشرع الجزائري منح له عقوبةجزائية ردعية وفقالأمر 09/01 المعدل والمتمم لقانون العقوبات

Resumé: Le contrat le cadeau pour les organes humains est que une personne de l’adulte est un membre de ses membres qui fait un don a une personne L’autre qui est dans le plus nécessaire de ce membre et cela se fait sans frais et avec un consentement total du donneur et l’acceptation du destinataire et que ce processus a été critique et une différence de théories entre les lois et la jurisprudence et droit islamique il Ya ceux qui autorisent ce processus alors qu’Ilya a une autre opinion qui refuse de le faire et toutes étaient ils sont humilies par des ses piliers comme c’est le cas dans le reste des contrats et les questions de retour dans le cadeau ne peuvent reussirqu avec une excuse acceptable et cela est interdital’exception de ceux qui ont droit a cela conformémenta la loi qui est soumise a la violation des controleslegal le législateuralgérien lui a accords une sanction pénaledissuasif selon le décret 01/09 et le complément pour le code pénal.
