المسؤولية المدنية الناشئة عن الطعون الكيدية-دراسة مقارنة

Abstract

ملخص: في هذا العمل تناولنا المسئوليةالمدنيةالناشئة عن الطعون الكيدية، قد أخذنا جانب مضمون الدعوى الكيدية وكذا التعسف في استعمال التقاضي، كما أدرجنا أركان التي تقوم عليها المسؤولية المدنية، اضافة الى تحديد أطراف الدعوى، وفي نهاية البحث، قمنا بتحديد كيفية التصدي للطعون الكيدية القائمة على المسؤولية المدنية، وفق قوانين وتشريعات بعض الدول من بينها الجزائر. قسمنا البحث إلى فصلين:  في الفصل الأول: قمنا بدراسة انعقاد الدعوى الكيدية وتحديد أطرافها ومظاهرها وأحكام التقاضي.  الفصل الثاني: بدراسة آثار قيام الدعوى الكيدية للمسؤولية المدنية وكيفية التصدي لها من قبل التشريعات. وفي ختامنا لهذا العمل، تطرقنا إلى جملة من توصيات حول المسؤولية المدنية عن الطعون الكيدية وكيفية ضبط التقاضي كي لا يتم الوقوع في التعسف والذي يؤدي إلى التحايل على القانون ومبدأ العدالة.

Abstract : In This work , we have dealtwith the civil liabilityarisingfrom the maliciouslitigation, we have taken the aspect of the content of the maliciouslitigation as well as the abuse in the use of litigation, and we have alsoincluded the pillars on which the civil liabilityLiabilityisbased, in addition to identifying the parties to the lawsuit, and at the end of the research, we have determined how to deal withmalicious calls based on civil liability, according to the laws and regulations of certain countries, including the 'Algeria.We have divided the researchintotwochapters : In the first chapter : westudied the convening of the malicious trial and identifiedits parties, its manifestations and itscontentious provisions. ChapterTwo : Studying the effects of malicious action in civil liability and how to remedythemthroughlegislation. At the end of thiswork, wediscussed a number of recommendations on the civil liability of maliciousrecourse and on the way to control litigationso as not to fallintoarbitrarinesswhich leads to the circumvention of the law and the principle of justice. .

Résumé : Dans ce travail, nous avons traité de la responsabilité civile découlant du litige malveillant, nous avons pris l'aspect du contenu du litige malveillant ainsi que l'abus dans l'utilisation du litige, et nous avons également inclus les piliers sur lesquels repose le responsabilité civile La responsabilité est basée, en plus d'identifier les parties au procès, et à la fin de la recherche, nous avons déterminé comment traiter les appels malveillants basés sur la responsabilité civile, selon les lois et règlements de certains pays, y compris le 'Algérie. Nous avons divisé la recherche en deux chapitres :  Dans le premier chapitre : nous avons étudié la convocation du procès malveillant et identifié ses intervenants, ses manifestations et ses dispositions contentieuses.  Chapitre Deux : Étudier les effets de la malveillance en responsabilité civile et comment y remédier par la législation. A la fin de ce travail, nous avons discuté un certain nombre de recommandations sur la responsabilité civile des recours malveillants et sur la manière de maîtriser le contentieux pour ne pas tomber dans l'arbitraire qui conduit au contournement de la loi et du principe de justice.
