الدور الإيجابي لقاضي شؤون الأسرة في استمرار الرابطة الزوجية

Abstract

ملخص: الأسرة تعتبروحدة أساسيةفي المجتمعات ،حيثي أخذالزواج دورًارئيسيًافي تكوين الأسرة. ولذلك،وضعت الشريعة الإسلامية شروطًاوضوابط الإنشاءالأسرة نظرًالأهميتها. ونظمتق وانين الأسرةالزواج وقيده،وضمان الرابطة الزوجية وتجنبحدوثمشاكلوانشقاقات. وفي حالة حدوث مشاكل واختلافات تؤديإلى الطلاق أوالخلع،فإن الشريعةالإسلامية وضعت ضوابطًالفك الرابطةالزوجية. وقداستمدالمشرع مشروعيتهمن الشريعةالإسلامية،ونظمالإجراءات اللازمة لعملية الصلح وإصلاح العلاقة الزوجية بصفة خاصة ،قبل فك الرابطة الزوجية،عن طريق قاضي شؤون الأسرة كدورإيجابي لاستمرارالرابطة الزوجية.

Abstract: The family is considered a fundamental unit in societies, where marriage plays a crucial role in its formation. Therefore, Islamic law has established conditions and regulations for establishing a family due to its significance. Family laws govern marriage, its registration, ensuring the marital bond, and avoiding problems and divisions. In the case of problems and differences leading to divorce or separation, Islamic law has set guidelines for the dissolution of the marital bond. The legislator derived legitimacy from Islamic law and regulated the necessary procedures for reconciliation and repairing the marital relationship, particularly before dissolving the marital bond, through a family affairs judge as a positive role for the continuity of the marital bond.

Résumé : La famille est considérée comme une unité fondamentale dans les sociétés, où le mariage joue un rôle primordial dans la formation de la famille. C'est pourquoi la loi islamique a établi des conditions et des règles pour la création de la famille en raison de son importance. Les lois familiales régissent le mariage, son enregistrement, garantissent le lien conjugal et évitent les problèmes et les divisions. En cas de problèmes et de divergences conduisant au divorce ou à la séparation, la loi islamique a établi des règles pour dissoudre le lien conjugal. Le législateur a puisé sa légitimité dans la loi islamique et a organisé les procédures nécessaires pour la réconciliation et la réparation de la relation conjugale, en particulier avant de dissoudre le lien conjugal, par le biais d'un juge des affaires familiales, en tant que rôle positif pour la continuité du lien conjugal.
