دور المسار الإجرائي التحضيري للصفقات العمومية في تأمين نجاعتها

Abstract

ملخص: إن تتبع المسار الإجرائي في التحضير للصفقات العمومية، وقبل الإعلان عن طلبات العروض تحدده مرحلتين مهمتين، تتمثلان في التحديد المسبق للحاجات العامة، وإعداد دفاتر الشروط، فمرحلة التحديد المسبق للحاجات العامة، يجب أن تراعى فيها الدقة والمصداقية للوصول إلى تصور لطريقة التنفيذ وتحقيق نجاعة الطلب العمومي، ويتجسد ذلك في التقدير الإداري الصادق والعقلاني الصادر عن المصلحة المتعاقدة، أما فيما يخص إعداد دفاتر الشروط والمتضمنة الشروط العامة والتقنية والخاصة، فتحدد معالمه المرحلة الأولى، إضافة إلى المعايير الموضوعية حسب طبيعة الصفقة العمومية، ليتحدد على ضوئها طريقة إبرام الصفقة، وكذا المتعامل المتعاقد، ولجنة الصفقات المختصة لرقابة مشروع دفاتر الشروط، والوصول لنتيجة رشادة المال العام.

Résumé: Le suivi de la piste procédurale dans la préparation des marchés publics, avant l’annonce des appels d’offres est précisée par deux importantes étapes qui sont représentées par : « l’indentification au préalable des besoins publics » et de « l’élaboration des cahiers de charges ». L’étape de « l’identification préalable des besoins publics » doit prendre en considération : « la précision » et la « crédibilité » afin d’aboutir à la conception d’un moyen de mise en œuvre et d’assuré la performance des commandes publiques, cela s’incarne dans l’estime administrative sincère et raisonnable délivré par le service contractant, un ce qui concerne « l’élaboration du cahier de charges » qui comprend les conditions générales, techniques et spécifiques, ses caractéristiques sont déterminées par la première étape. De plus, normes objectives selon la nature du marché public pour déterminer le moyen de passation du marché, ainsi que le cocontractant et la commission des marchés spécialisés dans la surveillance des projets des cahiers de charges et aboutir au résultat de gestion des argents publics

Abstract: To follow the suitable procedural way in preparing for the public deals, of course, before announcing demands of supplies, is determined by two considerable, important stages. The two phases states previously the public needs and books of conditions as well. First to prepare public requirements, Precision and credibility must be taken into account so as to get a way that helps to implement and achieve the public request effectively and this appears clearly in true, administrative appreciation. Second, as for the preparation of book of conditions which in clued general, technical and special conditions, and according to the nature of the public deals and the objective standards the public deals, the contracting side and the qualified deals committee can be determined to control this project and manage the public funds (finances) correctly.
