Abstract: The document of the statute of the International Criminal Court came under an important demand and endeavor, which is to reach universality, and as every international agreement, its provisions were fraught with many difficulties and problems, and this is expected. The establishment of the International Criminal Court came to perpetuate the full and real concept of international public opinion, not just transnational or between states, which will achieve an unprecedented adaptation of state sovereignty, and it is one of the largest expressions that affect the exercise of criminal jurisdiction, using the inductive approach and Legal rooting with historical analysis, and accordingly the Basic Statute document dealt with the mechanism of reservation with a kind of privacy according to its provisions, which contributed to crystallizing a distinct dealing with it, and all this appears through international practices, which varied and mastered in presenting their interpretations and points of view to show to the surface the international equation “sovereignty, Commitment practices, which varied and excelled in presenting their interpretations and points of view to show to the surface the international equation “sovereignty, obligation”
