Abstract

تتمحور الدراسة حول الوقوف على ما يقتضيه المركز القانوني للوقف العام في التشريع الجزائري، الذي اعتبره مجموعة أموال تتمتع بشخصية اعتبارية، متماشيا مع ما هو متفق عليه شرعا أنّ الوقف عموما يتميّز بضعف مركزه القانوني، مثل مال اليتيم والقاصر، فهو بحاجة لرعاية وتنمية حتى تتحقق الغاية المرجوة منه، فأسند ولايته العامّة للدولة التي تسهر على ذلك وتعمل على احترام وتنفيذ إرادة الواقفين، وتمّ اسناد تسييره لإدارة لم تحظى بالقدر الكافي من الاستقلالية التي تحقق فعالية أدائها خاصة من ناحية اتخاذ القرارات، وهذا مالا يرقى إلى مستوى تطلعات الواقفين والباحثين في مجال الأوقاف، كما منع التصرف فيه تصرفا ناقلا للملكية، واستثناء وإعمالا لمصلحة الوقف أجاز إحداث التغيير فيه بالبناء أو الغرس مع إلحاق ما تمّ إحداثه بملكية الوقف العام، وشدّد في الحالات التي تستوجب استبداله في حين ترك فراغ قانوني فيما يتعلّق بإجراءات الاستبدال والجهة المسؤولة عنه. Abstract: The study focuses on what is required by the legal status of a public endowment(waqf)in Algerian legislation, which it considers to be a moral group of funds, in line with what is legitimately agreed that the moratorium is generally characterized by its weak legal status, like orphans' and minors' money, it needs to be nurtured and developed in order to achieve its intended purpose. It is entrusted with the general mandate of the State, which ensures that the will of those who stand is respected and implemented. Its management has been entrusted to an administration, which amounts to the aspirations of the endowment defenders and researchers, and has prevented its disposal as a transferee of property. An exception in the interest of the moratorium allowed the change to be made to build or instill while placing ownership of the public moratorium on its development, and stressed that in cases requiring its replacement, a legal vacuum with regard to the replacement procedure and who is responsible. .
