Abstract

تبنى المشرع الجزائري سلسلة من التعديلات على قانون الإجراءات الجزائية فيما يتعلق بنظام الوساطة في القضايا الجنائية، والتي تم تأكيدها في قانون حماية الطفل 15-12 المؤرخ في 19 يوليو 2015. وهي "آلية قانونية تهدف إلى إبرام اتفاق بين الطفل الجاني وممثله القانوني من جهة والضحية أو صاحب الحق الشرعي من جهة أخرى"، بهدف إنهاء الإجراءات وجبر الضرر الذي لحق بالضحية وإنهاء آثار الجريمة والمساهمة في إعادة تأهيل الطفل اجتماعياً. لذا، يركز هذا المقال على نظام الوساطة كآلية لحماية الأحداث الجانحين، موضحاً الأحكام الموضوعية والإجرائية وآثارها، وشروط إبرام الوساطة والشروط المتعلقة بأطراف الوساطة. Abtract: The Algerian legislator adopted a series of amendments to the Code of Criminal Procedure regarding the mediation system in criminal cases, which were confirmed in the Child Protection Law 15-12 of July 19, 2015. It is “a legal mechanism aimed at concluding an agreement between the child offender and his legal representative on the one hand and the victim.” Or the legitimate right holder on the other hand,” with the aim of ending the procedures, redressing the harm suffered by the victim, ending the effects of the crime, and contributing to the social rehabilitation of the child. Therefore, this article focuses on the mediation system as a mechanism for protecting juvenile offenders, explaining the substantive and procedural provisions and their effects, the conditions for concluding mediation and the conditions related to the parties to the mediation.
