Abstract

تبنى المشرع الجزائري النظام القضائي الموحد للفصل في المنازعات التي قد تنشأ بين التجار وطنيين أو أجانب والمثارة عند تنفيذ التزاماتهم التعاقدية، إذ أنه بصدور قانون الإجراءات المدنية والإدارية رقم 08-03 المعدل والمتمم فقد أنشأ من خلال نصوصه الأقسام التجارية على مستوى المحاكم كما استحدث الأقطاب المتخصصة المنعقدة في بعض المحاكم التي تفصل في المنازعات ذات الطبيعة الخاصة لكن مع ذلك لم يخصص لها هيكل قضائي منفصل عن المحكمة، ومع ثبوت فشل نظام هذه الأقطاب التي لم تنصب أصلا ومن أجل تشجيع الاستثمار الوطني والأجنبي كان لزاما على المشرع إعادة النظر في منظومته القضائية باستحداث جهاز قضائي تجاري متخصص ومستقل عن المحاكم وذلك بموجب القانون رقم 22-13 أطلق عليه المحكمة التجارية المتخصصة محددا لها نظامها القانوني. Abstract: The Algerian legislator has adopted a unified judicial system for resolving disputes that may arise between traders, whether they are nationals or foreigners, in relation to the execution of their contractual obligations. With the issuance of Law No. 08-03 on Civil and Administrative Procedures, which has been amended and supplemented, the legislator established commercial divisions within the courts. It also introduced specialized chambers that convene in certain courts to adjudicate disputes of a specific nature. However, these specialized chambers did not have a separate judicial structure. Given the evident shortcomings of this system, especially since these specialized chambers were not originally established, and in order to promote both domestic and foreign investment, the legislator found it necessary to reconsider the judicial system by creating an independent and specialized commercial judicial body separate from the regular courts. This was accomplished through Law No. 22-13, which established the Specialized Commercial Court and defined its legal framework
