Abstract

عتبر مسألة حماية الثروة الغابية من أهم المواضيع عل المستوى الداخلي للدولة لما لها من دور فعال في مجال المحافظة على البيئة والمساهمة في توازنها، بالإضافة إلى دورها في تحقيق التنمية الاقتصادية، غير أنه لا تتحقق هذه الحماية إلا إذا كانت العقوبات التي أقرها المشرع لمواجهة الأفعال الماسة بالثروة الغابية يتحقق معها الردع الخاص والعام، حيث يقتضي أن يتناسب الجزاء مع خطورة الأفعال التي من شأنها المساس بالثروة الغابية. وهو ما حاول المشرع الجزائري تكريسه ضمن منظومته القانونية. Abstract: The issue of protection of forest wealth is one of the most important issues at the internal level of the state because of its effective role in preserving the environment and contributing to its balance, in addition to its role in achieving economic development however, such protection can only be achieved if the penalties approved by the Legislature for acts affecting forest wealth are met with private and public deterrence, as it requires that the penalty be commensurate with the seriousness of acts that would prejudice forest wealth. This is what the Algerian legislator tried to enshrine within his legal system.
