Abstract

تقتضي حماية الطفل بالدرجة الأولى وجود قانون خاص به، وهو ما كرسه المشرع الجزائري بإصداره القانون رقم 15-12 المؤرخ في 15 يوليو 2015 يتعلق بحماية الطفل، حيث تعد الحماية القضائية أحد أهم آليات حمايته، تعمل على توفير حماية قضائية للحدث من خلال اتخاذ كافة الإجراءات والتدابير التي من شأنها التعرف على وضعية الطفل وإنقاذه سواء كانت هذه التدابير مؤقتة أو نهائية. غير أن ما يمكن ملاحظته على مستوى الممارسة والتطبيق، وجود الكثير من العقبات والمعوقات تحول دون تجسيد هذه الحماية في الواقع فأنقصت بذلك من فعاليتها وجدواها، وسنحاول الوقوف عند أهم الثغرات القانونية المتعلقة بها.
