Constitutionalisation of Judicial Independence: A Principle Dictated by Contemporary Democratic Values دسترة استقلالية العدالة: مبدأ تميله القيم الديمقراطية المعاصرة

Abstract

حاول التعديل الدستوري لسنة 2020 إدخال إصلاحات عميقة تتعلق بتنظيم السلطات العمومية من الداخل، ولاسيما استقلالية السلطة القضائية التي تعد مرآة عاكسة لدولة القانون، من خلال ضبط مبدأ الاختصاص الوظيفي بين السلطات، مع جعل السلطة القضائية تتمتع بكافة الصلاحيات لإعلاء كلمة سيادة القانون، ووضع حد لسلوكيات الماسة بحقوق وحريات الأفراد، مع تكليف المجلس الأعلى للقضاء بحماية استقلالية القاضي في سبيل ضمان المحاكمة العادلة، وتفعيل المبادئ العالمية له على شاكلة مبدأ التقاضي على درجتين سواء في المواد الجزائية، أو في المواد الإدارية. This study endeavours to shed light on the constitutionalisation of judicial independence. The 2020 constitutional amendment sought to enact significant reforms pertaining to the structure of public authorities, particularly focusing on bolstering the autonomy of the judiciary—a pivotal aspect reflective of the rule of law. This reform aimed to delineate functional jurisdictional boundaries among authorities, empowering the judiciary with comprehensive authority to safeguard legal principles, curb behaviours impinging upon individual rights and freedoms, and vesting the Supreme Judicial Council with the responsibility of safeguarding judicial independence to ensure equitable judicial proceedings. Additionally, the amendment aimed at operationalising universal principles such as the two-tier litigation system, applicable in both criminal and administrative domains.
