Abstract

تميزت جرائم الأعمال بخصائص فريدة تستدعي معالجة قانونية خاصة بها. تُعزى هذه الخصائص إلى صعوبة تطبيق القواعد العامة للقانون الجزائي، مما دفع المشرع إلى تكييف القوانين لمواجهة هذا التحدي. من الناحية الإجرائية، جسد المشرع هذه الخصوصية من خلال إنشاء هيئات قضائية متخصصة في معالجة جرائم الأعمال، وتعزيز دور الإدارة في إدارة الدعوى العمومية والمصالحة، إلى جانب استحداث أساليب خاصة بالبحث والتحري.

Les délits commerciaux présentent des caractéristiques uniques qui nécessitent leur propre traitement juridique. Ces caractéristiques sont dues à la difficulté d'appliquer les règles générales du droit pénal, ce qui a poussé le législateur à adapter les lois pour relever ce défi. Sur le plan procédural, le législateur a incarné cette spécificité en créant des organes judiciaires spécialisés dans le traitement des délits commerciaux, en renforçant le rôle de l'administration dans la gestion du contentieux public et de la réconciliation, ainsi qu'en développant des méthodes particulières de recherche et d'enquête.

Business crimes have unique characteristics that require their own legal treatment. These characteristics are due to the difficulty of applying the general rules of criminal law, which prompted the legislator to adapt laws to meet this challenge. From a procedural standpoint, the legislator embodied this specificity by establishing judicial bodies specialized in dealing with business crimes, strengthening the role of the administration in managing public litigation and reconciliation, in addition to developing special methods of research and investigation.
