Abstract

إن حقوق الملكية الصناعية تلعب دور محوريا و جوهريا في تشجيع الاستثمار الأجنبي التي باتت تعتبر إحدى اهتمامات القانون المعاصر و لا سيما قانون الأعمال ، وكذا الدور الذي تلعبه في جلب استقطاب المستثمر الأجنبي ، وعلى هذا الأساس سعت الجزائر منذ الاستقلال إلى يومنا هذا الى إنشاء منظومة قانونية لحماية حقوق الملكية الصناعية عن طريق توفير حماية مدنية أخرى جزائية نظير تشجيع الاستثمارات الأجنبية في مجال حقوق الملكية الصناعية على إقليم الدولة

Industrial property rights play a pivotal and fundamental role in encouraging foreign investment, which has become considered one of the concerns of contemporary law, especially business law, as well as the role it plays in attracting foreign investors. On this basis, Algeria has sought, since independence to the present day, to create A legal system to protect industrial property rights by providing civil and other penal protection in exchange for encouraging foreign investments in the field of industrial property rights on the state’s territory.

Les droits de propriété industrielle jouent un rôle central et fondamental dans l'encouragement des investissements étrangers, devenus considérés comme l'une des préoccupations du droit contemporain, notamment du droit des affaires, ainsi que le rôle qu'ils jouent pour attirer les investisseurs étrangers. depuis l’indépendance jusqu’à nos jours, créer un système juridique pour protéger les droits de propriété industrielle en fournissant une protection civile et pénale en échange de l’encouragement des investissements étrangers dans le domaine des droits de propriété industrielle sur le territoire de l’État.
