Abstract

إن الأعراف التجارية حقيقة لا يمكن تجاهلها في العقود التجارية الدولية، فهي تتصف بالعمومية والتجريد والتلقائية في نشأتها، إذا أنها من خلق الجماعات المهنية والتجارية، وليست من وضع السلطة صاحبة التشريع لأية دولة، و تعد ليكس مركاتوريا أول مجموعة لقواعد موضوعية تسري على التجارة الدولية، و تحظى باحترام كبير لدى التجار , ولا تزال بقاياها في الوقت الحاضر بل منها ما تولت بعض الهيئات الدولية كغرفة التجارة الدولية جمعها ونشرها مثل مصطلحات التجارة الدولية “الإنكوترمز” والأعراف الموحدة للاعتماد المستنديالكلمات المفتاحية.
