النظام القانوني للتاجر الأجنبي

Abstract

إن دراسة النظام القانوني للتاجر الأجنبي في التشريع الجزائري تتطلب جانبين مهمين .فالجانب الاول يتمحور حول معرفة أحكام التاجر الأجنبي من حيث صفة الأجنبي و صفة التاجر القانونية . فالمشرع الجزائري اعترف للأجنبي بالشخصية القانونية و حدد مركزه القانوني على اسس مختلفة ، ففي الجانب التجاري اعتمد غالبا على مبدأ التسوية بين الأجنبي و الوطني و التمييز عند الزام التاجر الأجنبي بالحصول على بطاقة الاقامة و البطاقة المهنية للتاجر الأجنبي . و الجانب الثاني حول التزامات التاجر الأجنبي التي لا تختلف كثيرا على التزامات التاجر الوطني من حيث مسك الدفاتر التجارية و القيد في السجل التجاري و جزاءات التخلف عنها.

L'étude du régime juridique de commerçant étranger dans la législation algérienne nécessite deux aspects importants .Le premier aspect concerne la connaissance du concept de commerçant étranger en termes de statut d'étranger et de statut juridique de commerçant . Sur le plan commercial, il s'est souvent appuyé sur le principe du compromis entre l'étranger et le ressortissant et de la discrimination pour obliger le commerçant étranger à obtenir une carte de séjour et la carte professionnelle du commerçant étranger . Et le deuxième aspect concerne les obligations d'un commerçant étranger, qui ne diffèrent pas beaucoup des obligations d'un commerçant national en termes de comptabilité commerciale, d'inscription au registre du commerce et de pénalités en cas de défaut.

Studying the legal system for the foreign trader in Algerian legislation requires two important aspects. The first aspect turns around knowing the concept of the foreign trader in terms of the status of the foreigner and the legal status of the trader. The Algerian legislator aknowledgedto the foreigner the legal personality .He determined this legal status on various bases. On the commercial side, he often relied on the principle of egalitarianism between the foreigner and the national and discrimination when obliging the foreign trader to obtain the residence card and the professional card of the foreign trader. The second aspect concerns the obligations of the foreign trader, which do not differ greatly from the obligations of the national one in terms of maintaining commercial books, registration in thenationalcenterof trade register, and penalties for defaulting on them.
