Abstract

إن انتهاج الجزائر لاقتصاد المعرفة يتبلور في اهتمامها بالمؤسسات الناشئة كأحد الحلول تنويع الاقتصاد والتخلص من الاعتماد الكلي على قطاع المحروقات، والتي تعتمد أساساعلى الإنتاج الفكري البشري الذي يتجسد في الابتكار جوهر الملكية الفكرية. وبينما تطمح المؤسسات الناشئة إلى النمو السريع وتعزيز مكانتها في السوق ،فإ نرغبتها في الحصول على التمويل تجعلها عرضة لسرقة أفكارها، تقليدها، قرصنته اواستغلالها تجاريا،خاصةمن قبل الشركات الكبيرة والمنافسين ما استوجب إقرار ضمانات فعالة لحماية رأسمالها الفكري.لذا أقر المشرع الجزائري نظاما قانونيا محكماً يضمن حماية حقوق الملكية الفكرية للمؤسسة الناشئة بواسطة عدة آليات ، وفرض عقوبات على كل معتد عليها.

L'approche algérienne de l'économie de la connaissance se cristallise dans son intérêt pour les institutions émergentes comme l'une des solutions pour diversifier l'économie et sortir de la dépendance au secteur des hydrocarbures, car elle repose principalement sur la production intellectuelle humaine à travers l'innovation, qui est l'essence de la propriété intellectuelle. Comme elle aspire à une croissance rapide et à renforcer sa position sur le marché, son désir d'obtenir des financements la rend vulnérable au vol de ses idées, à l'imitation, au piratage et à l'exploitation commerciale, notamment par les grandes entreprises et les concurrents.
